These General Commercial Terms shall apply to all commercial relationships between the Customer and Atlas Tiles in their current version at the time of ordering for deliveries of all kinds provided by Atlas Tiles to its Customer, to the extent that no contradictory written agreements are reached in a purchase or other contract concluded between Atlas Tiles and the Customer. Legally relevant declarations and notifications from the Customer after the conclusion of the contract (e.g., setting of deadlines, defect reports, cancellation or reduction statements) require the written form to be valid.

Orders

When you place an order on our Online Store, you will receive an email confirmation of the receipt of your order. This does not constitute an acceptance of your order as we regretfully cannot guarantee the availability of the products advertised on our website. Your order is accepted when we confirm by email that your order has been dispatched.

 

Digital images, catalogues, and other advertising materials are only indications of the type of products offered and are subject to variations.

 

All prices displayed on our website are in euros and include value-added tax. Prices may occasionally differ from those displayed on our website. If this happens, we will not send your order until we have informed you and you have accepted the purchase at the new price.

 

We reserve the right to accept or reject your order, even after receiving an order confirmation, for any reason, including an error in the advertised price or product description, or any other error related to the products. If we reject your order, we will contact you by phone or email to arrange a full refund of any payment made.

 

Delivery Date, Delivery Conditions, and Shipping Cost

Delivery Time: Between 10 to 20 working days from the order processing date. Please note that delivery dates are only estimates. We do not accept liability for failure to deliver goods within the specified times as a result of shipping delays.

We appreciate your understanding during this challenging time and would like to assure you that we are doing our best to process your order as soon as possible.

Any quantity less than 10 boxes will not be shipped unless accompanied by other materials or is a completion of previous orders.

 

Delivery and Unloading:

We ship tiles to any destination within the European Union.

Tiles are delivered on trucks equipped with a lifting device and are unloaded from the truck at the customer's delivery address, unless otherwise indicated by the dedicated customer service specialist when confirming the order. Therefore, the customer will ensure that the delivery location is fully accessible for such vehicles and that there is sufficient space for unloading the goods. Delivery to historical city centres and other areas with limited truck traffic and no possibility of unloading the goods may incur additional shipping costs.

Important! If you are unsure whether the truck will have full access to the delivery address and if there will be enough space to unload the goods, please contact your dedicated customer service specialist so that we can suggest alternative goods delivery routes before confirming the order.

If you wish to arrange unloading of goods from the truck yourself, please contact your dedicated customer service specialist so that we can recalculate the shipping costs and inform you of any differences.

 

Goods Delivery:

Goods Delivery: Goods will not be shipped for delivery without first receiving full payment.

Deliveries of tile pallets will be made with large vehicles using elevating platforms to the nearest curb. Our pallet couriers cannot carry these items inside the property or move any items to the desired floor of the house due to insurance reasons.

It is the customer's responsibility, and at the discretion of the driver, whether delivery is accepted anywhere on the customer's property. If you refuse delivery because the driver cannot leave it at your door, you will be charged the actual delivery and collection costs.

Once the goods are delivered, the customer will visually inspect them. In the event of any damage to the packaging, the customer must indicate this on the delivery note.

The customer or the instructed recipient of the delivery must open and check the order for damage in the presence of the driver before signing any courier paperwork.

Please visually inspect the pallets. Check if the plastic covering is damaged, all corners, and the wooden pallet. If you notice any damage to the plastic covering or the wooden pallet, write "EXTERIOR DAMAGED" on the delivery receipt.

In the unlikely event that an item is damaged, note it on the courier's Proof of Delivery (POD): 'DAMAGED' along with the product description and take photographs. It is not necessary to return defective goods to the carrier.

Do not handle the pallet goods until photos are taken.

If you have not identified any damage on the outside of the pallet but cannot verify the goods, note on the POD: "UNCHECKED." We cannot accept any claims once the POD is clean.

We cover 100% of any breakage or damage as long as the above terms are met.

In the unlikely event that an item is damaged during transport, contact Atlas Tiles via email: info@atlastiles.ie within 24 hours of receiving your delivery and send us the proof of delivery along with images.

We will reimburse the costs of such goods or replace them as soon as possible.

 

Shipping Costs:

Shipping is shown separately when purchasing each product. For countries other than Ireland, please contact us by email: info@atlastiles.ie.

 

Cancellation and Return of Goods:

Within 24 hours, the customer can cancel the order once placed. After 24 hours, the order cannot be cancelled if it has already been shipped. You have the legal right to return those unopened products up to 14 days after receiving your order, which also applies to defective or incorrect orders. You must send us an email at info@atlastiles.ie indicating that you want to return your order. We will refund the purchase price excluding shipping costs.

All returned products are subject to a 20% restocking fee and must be accompanied by a valid receipt.

However, please note that the cancellation of non-stocked products will not be accepted once your order has been processed, and no returns or exchanges will be available.

Returned goods are returned at your risk and cost. They must be returned unopened, securely wrapped, and including our delivery note.

 

Return of Defective Goods Received:

We ask customers to thoroughly inspect all products received on the day of delivery. To ensure a speedy resolution, we must be notified of any items that arrive defective or damaged within 24 hours of receipt. We will then indicate the next course of action, contact you, and arrange for the pickup, request the return of the products, or the disposal of the products; never dispose of the products without our notification.

Please note: all products reported as defective will be tested by the manufacturers. If it is determined that the products are not defective or if the failures are considered to be due to damage or abuse, this will void any warranty, the products will be returned to you, and no refund or replacement will be issued.

 

Prices

All prices displayed on our website are in euros and include value-added tax. In the case of a corporate customer registered in the EU having an international VAT identification number, the respective order invoice is issued without VAT, and the VAT identification number of the supplying company is specified.

 

Payment

Atlas Tiles offers payment by credit card, debit card, bank transfer, PayPal, and Stripe.

 

Warranty

All Atlas Tiles products come with a minimum of 12 months manufacturer's warranty, many products are listed with periods exceeding 12 months, in these cases, the indicated period remains a manufacturer's warranty.

 

 Different manufacturers have different procedures for handling defects; in some cases, we will handle the replacement of goods on your behalf, while some companies will only deal directly with customers, so we will provide you with all relevant contacts and information, and then they will handle repairs, replacements, or advise on alternative procedures.

Please note: all products reported as defective will be tested by the manufacturers. If it is determined that the products are not defective or if the failures are considered to be due to damage or abuse, this will void any warranty, the products will be returned to you, and no refund or replacement will be issued.

 

Product Presentations and Warranties

Product presentations on the website may differ in colour and print from the actual items. References to products do not represent any guarantee. An additional guarantee exists with goods delivered by Atlas Tiles only if explicitly indicated on the website for the respective item. In this case, special manufacturer's warranty conditions for the item will also be displayed on the website.

We may make changes to our terms and conditions at any time without prior notice. The terms that apply to you are those published on our website on the day you place your order.

Data Protection

Customer data collected in the context of an order will be processed and used by Atlas Tiles to establish, execute, and terminate the contractual relationship with the Customer, particularly to process warranty claims. Customer's personal data will only be transmitted to third parties if and to the extent necessary to fulfil the contract, especially for carrying out the delivery.

The use of the email address for advertising purposes is only carried out if the Customer has given consent to this effect. The same will apply accordingly to the use of such data for market or opinion research.

 

Law and Jurisdiction

These terms and conditions shall be governed and interpreted in accordance with Spanish law, and any dispute relating to these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of Spain.
